explanation: A mere complaint cannot be an offense under any act, the provisions of revenue intellgence should be applied This clause will kill the soul purpose of the Lokpal. and is nullifying Section 8 it seems and proves that the the drafters unwillingness to implement the provisions of the prevention of corruption and an enquiry may be started after the act coming in to force on the people as to why an action should not be taken on them on "framing a draft which has contradicting provisions within the same bill causing damage to the public interests". It is the duty of Lokpal to find if a prima facie exists and proceed accordingly.The fear of complaint will be more effective than the complaint it self on the corruption prone public/government servants. the performance of the lokpal should be measured by the total complaints vs the cases filed and settled. if the complaints are discouraged then the lokapal is useless and will become a white elephant on the exchequer.

The Lokpal bill intends to set a new institution. The bill should make sure that Lokpal and its staff are are selected in a manner which is independent of the government and UPSC or State PSC.
The Lokpal staff shall be selected without any age discrimination. Age discrimination is biggest reason why Indian bureaucracy is so corrupt.
The staff of Lokpal should not be revelling in security of a lifetime government job. The Staff within the lokpal should compete with people outside. 50% of staff at all levels shall be non permanent and may even be part time workers.

1) Lokpal should have powers to confiscate assets of any person/govt servant for which no income tax returns filed.
2) Assets gained by illegal gratification should be confiscated to govt without enquiry.
2) Any asset/ money which is not come under legal transaction should be considered as state's property.
3) Benami transaction act should be strengthened in this regard.
4) Transparent administration to curb corruption should be included in central list, state govts are forced enact the same.
5) Lokayukta should also be made compulsory in all states.
6) A govt.servant involved in corruption should be discharged from duty subject to his reinstatement if proved innocent.

in 1 and 2 Define "whistle blower" is an exlected person public servant? does the term include government servant?

There is a need for creation of a Lok Pal representative panel at every Ward Level of our country so that it is easier for the common people to report bribe / extortion cases. The onus of creating such facility to the public is the joint responsibility of the Central and State Governments.

विचार-(१)- " बिल के अंतर्गत जाँच के दायरे में ऐसे सभी नागरिक होने चाहिए| जिन्हें किसी भी मद/रूप में सरकारी कोष से एक वित्तीय वर्ष में निश्चित की गयी मात्रा से अधिक धन उपलब्ध कराया गया हो, आयकर नियम को भी आधार बनाया जा सकता है|
(२)- नियम, कायदे कानून तैयार किये जाने व् लागू किये जाने के बाद भारत में उसके प्रभावी क्रियान्वयन कराये जाने की नितांत आवशकता का ध्यान भी रखना आवशयक होगा|

Sir i have 3 recommendation for the lokpal bill sir.
1.sir there should be a all india helpline number regarding the complaints against any corrupt officials.
2.sir we have so many cases pending in our courts.although fast track courts are there but still then there are lot of cases are pending and one such case is of ajmal kasab who is a terrorist we al know stil then the judgement is yet to come.so in lokpal bill there should be clause that the judgement should be made within a reasonable time against the corrupted officers and beuracrats.
3.sir pls make the anti corruption bill so stringent that no corrupt officer wil ever take bribe in his life.

My dear Lokpal team,
We should be happy about that we got some foot hold to fight against corruption after 42 years.
Hats off to all of your team and everybody who supported it.It is our victory.Don't let your spirits down even
a bit with all these allegations to derail Lokpal bill passage.I expected the worst allegations..these are nothing.
The more they accuse you with allegations the more you should focus on core issue of LOKPAL.
All these hurdles(nuisance) make you more strong and better to address even bigger problems!
No matter how much they get worse,Don't give up!We all will support and stand by you all!
LokPal System:
We can't open flood gates of complains and collapse the LOKPAL system. There should be priority of
cases. Govt wants you take all the cases, people can easily get frustrated and it may lead to LOKPAL collapse!
Term for LoKPAL: Not all members should be elected at same time, there is possibility of getting all preferred
candidates. All members should have 7 year tenure and every 2 years at least two new members join the team,without increasing the size of core team.
Coverage: It should cover private sectors, NGOs, but at the same time LOKPAL can't be choked with flood of
complains.

This can be tricky to implement: The minimum bribe amount should not be less than 100,000 rupees to implement this! Encouraging Govt employees to go on wire to trap collusive corrupt people: We should reward public servants who can trap the collusive corrupt people, but they have to do under the supervision of ACB or CBI. For instance say a contractor offers 2 lackhs rupees to get contract..The officer should encourage to trap the giver with the help of ACB and CBI. The offer amount should be given to the public servant, plus 25% of the any monetary penalty imposed by LOKPAL on the giver too.
Givers:
Collusive corruption should attract strict punishment: Anyone is paying more than 100,000 rupees is treated as collusive corruption. They should get at least 1 year imprisonment. Any thing less than that should get first warning and penalty from any where 1000 Rupees to 100,000 Rupees. Above 1 lakh should get prison time plus 1 to 10 times of the bribe penalty.
Receivers (corrupt officer/public servant)
1) Once the charge sheet is filed, it is non bailable offense, the accused should be taken into custody
and put him in white collar crime jails with all amenities until he gets convicted.
2) Once the guilty is convicted, The convict can't appeal other courts, pardoned by anyone.
The minimum punishment should be 5 years non parole imprisonment. It should also increase based
on severity of charges.
Money recovery:
1)If the money is not recovered they should go strict imprisonment with very few privileges. We should also give
a scope for money recovery with lesser sentence , the lesser sentence shouldn't be less than 5 years. Plea bargain should be there to recover money.
Reward system for citizens and whistle blowers:
1)10% of the pension of the guilty goes to complaint, and another 10% to the lokpal and rest of the money will go to Indian treasury. If there is a big scam, the whistle blower should get at 10% or 1 crore rupees , whichever is less and govt protection. The LOKPAL should provide TA, DA, and BRIBE evidence money promptly to the complaint.
Abettors / brokers or Money hiders:
These are people who do the prime act for corrupt officers, they need to get not less than 10 years non parole imprisonment.
PENALTY UNDER PERJURY for LOKPAL:
We need to implement "PUP" for all accused, they all need to take oath during trial, if they found guilty of perjury
the imprisonment is even worse than original punishment. This works very well in US, people under oath usually don't lie in US because of the fear of severe punishment.
The ultimate winner never accepts hurdles and defeats, but fights until crushing victory.
The public got the taste of first victory, It just a matter of time ...We will win all battles.
